Your insureds routinely sign contracts. These contracts can and do require all kinds of things of the insured, some of which are insurance related. We are not attorneys. We shouldn’t be evaluating these contracts and providing any kind of legal opinion or advice. However, in our role as insurance professional we can and should at least be asking specific questions about these contracts. Is it a written contract? Are additional insured endorsements required? Is the additional insured to be covered during both the operations and completed operations phase? Are waivers of subrogation required? Is there a requirement for the insured’s policy to be primary and for the other party’s policy to be non-contributory?

• What do those terms actually mean?
• How does the standard ISO CGL policy address these issues?
• What endorsements are available to require this of the CGL policy?
• What about the Certificate of Insurance? Where does this information go?
